Tax Relief Proposed To Mitigate Casino Impacts May 14, 2003 WOODLAND -- A member of the Yolo County commission on tribal matters charged with spending $1.5 million suggested Monday that each Capay Valley property owner receive a tax rebate of between $500 and $1,000. Frank Rose of Capay made the suggestion at a meeting of the Yolo County Advisory Committee on Tribal Matters. The committee was formed to advise the Board of Supervisors on how to spend the money coming from the Rumsey Branch of Wintun Indians as part of a settlement reached last year. The tribe is expanding its casino operation on Highway 16 outside Brooks and agreed to pay the county $100 million between now and 2020. Carl Mack of Davis was elected chairman of the advisory committee and Jim Durst of Esparto is the vice chairman. The county received $1.9 million from the tribe in one-time costs for attorney and consultant fees, according to county analyst John Clark, and will receive $3 million by Oct. 1. That annual payment of $3 million will increase by a half-million dollars each year for five years and then the annual payment will be adjusted to the Consumer Price Index. The payments are being made to mitigate the profound effects the expanded casino and bingo parlor are having on the Capay Valley and the rest of Yolo County. The nine-member advisory committee was formed to review requests for mitigation and pass on recommendations to the board. This year, it will make suggestions on how a portion of the $3 million due the county will be spent. It will not be responsible for administering the entire $3 million because 40 percent will go straight into the county's General Fund, and the Yolo County sheriff has an ongoing commitment of $300,000 to cover the law-enforcement services provided to the casino. That leaves $1.5 million for the committee to allocate. Several mitigation requests have been made by Capay Valley residents, including Pam Welch and Tom Frederick, who asked for specific remediations and consideration of how the tribe's expansion will affect their plans to open a bed-and-breakfast inn. Other mitigations may range from money to build a sound wall along Highway 16 to litter removal, from money for a fire district to construction of a rest stop. On Monday, member Rose also asked for three mitigation measures, including the rehabilitation of all county roads from I-505 to the casino and a discount for all Capay Valley residents at the tribe's gas station and store. "Discounts are given to (casino) employees," Rose said. "We could partner in on that." He also asked for tax relief for the valley residents. "Each property owner should get relief," he said. The noise, traffic and glare from the expanded casino and new hotel will directly impact the residents. "So a tax rebate of $500 to $1,000, somewhere in there, would be a direct benefit to people suffering the impact," he said. Committee member Jackeline Medecki of Davis said Rose's proposal raised a legal red flag in her mind. "I don't know if it's doable," she said. All requests will be reviewed by the county counsel, Clark said. Analyst Clark also said county departments may be submitting requests for some mitigation dollars. He said, for instance, that 10 percent of the Yolo County public defender's caseload comes from the casino, mostly drug cases. The county Department of Alcohol, Drug and Mental Health Services also may apply for funds. Clark suggested that two award cycles take place this year, since county agencies have a fiscal calendar to follow. County departments should apply for funds by June 6. Private groups and community organizations will have until Aug. 15. "Requests are not coming in all that fast," he said. Several committee members expressed concern about the county helping itself to tribal mitigation dollars in order to balance its budget.
